Do I need a permit for a fence in San Jose?
Usually not. The city says a fence needs a building permit only when it goes over the maximum heights in the Municipal Code. The one doing the digging. When we install your fence, we notify USA North 811 at least 2 working days before we dig.

Repair if the damage is in one area and the posts are firm. Replace if repairs approach half the cost of a new fence or most posts are rotted.
Who pays for a fence between neighbors?
California presumes neighbors split the reasonable cost of a boundary fence equally, after 30 days' written notice (Civil Code section 841).
