Storm Damaged Fence in San Jose: What to Do and Who Pays

What to do when a winter storm or a fallen tree knocks down your fence in San Jose: fast repair, insurance, neighbor trees and temporary closures.

Storm Damaged Fence in San Jose: What to Do and Who Pays

When a storm took part of your fence, take photos of the fence and the cause first, then call your insurer and a fence contractor before you clear anything away. In San Jose the damage nearly always comes in winter, when an atmospheric river soaks the clay for days and the wind arrives behind it.

Half my fence blew down. Who can fix it fast and what will it cost?

Send us a picture and a rough length and we will tell you how soon we can be there. A run that blew down and broke its posts is a major repair, $900 to $2,500 in national 2026 figures. After a large storm every fence company in the valley gets busy within a day or two, so the sooner you call, the sooner you are on the list.

My dogs are in the yard and the fence is open to the road. What can be done right away?

We close the opening for now and come back for the real repair. Standing posts are braced, and a temporary panel goes across the gap. Mention on the call that dogs are in the yard, or that a pool is now open to the street, because those jobs go first.

Is there an extra charge for emergency or weekend fence repair?

Many companies do charge more after hours, and others simply do not go out then. Ask before you agree to a visit. The cheaper route is usually a quick closure right away and the full repair during the normal week.

Does homeowners insurance cover a fence knocked down by a storm or a tree?

Sometimes. Homeowners policies commonly put fences in the other structures part of the coverage. Whether a claim is paid depends on what caused the damage, your deductible and the policy language, and a modest repair may not reach the deductible at all. Only the insurance company or your agent can say for your policy. We can provide a written estimate for the claim.

My neighbor's tree fell on my fence. Whose insurance pays?

In most cases your own policy covers your fence, even though the tree stood next door. The answer can change when the tree was obviously dead or the owner had been told it was a hazard. Your insurer will tell you. For a fence on the shared line, read the note about California's fence statute further down.

The insurer offered much less than the repair quote because the fence is old. Now what?

Have the adjuster put the calculation on paper. Policies often pay the depreciated value of an old fence, which is less than the cost to rebuild it. Reply with an estimate broken into line items. If the gap does not close, fixing just the sections that came down is a common way through.

The storm knocked the fence down and my neighbor says it is mine. Who pays?

For a fence on the line between two lots, California Civil Code section 841 presumes both owners benefit and both are equally responsible for the reasonable cost of repair or replacement, unless a written agreement says otherwise. The location of the line itself is a job for a licensed land surveyor. We build fences and do not rule on boundaries. The notice steps are laid out on our shared fence page.

I was a little worried about my tenant's backyard and home being exposed, but these guys were fast, came in and took a look, Sam had a quote for me next day with a few pictures. I decided to…
